General

It is always advisable to engage with a good party wall surveyor early in the project. This will allow the surveyor to identify opportunities for improvement in the design, to spot issues before they arise, to enable easier construction of a better designed project. It will also give the opportunity to spot areas where the Party Wall Act can be designed out or used to your advantage. You will also ensure that all works are covered in the notices, (often missed by homeowners or chatGBT!!), and ensure you serve notice to all affected parties.

In short, specifically with loft conversions, a good party wall surveyor is worth their weight in gold.

The good news is that they will not heave the ability to prevent the works from proceeding, providing the works are permissible under the Act.

Disputes can often be avoided by having a surveyor serve the notices, and providing the neighbour with good advice. Where disputes are unavoidable the appointment of a surveyor or surveyors will be required. Whether there are 1 or 2 surveyors will be decided by the neighbour, so having a good, well respected, accredited specialist surveyor from the outset is critical. This will give you the best chance of the neighbour agreeing to co-appoint your surveyor.

The costs for resolving party wall matters in London can vary dramatically depending on several factors.

The complexity of the works. The more risk to the neighbouring properties often translates to higher costs.
The number of neighbours affected.
The relationship you have with your neighbours.
How professional and personable your surveyor is? Can your surveyor instil confidence and build rapport with your neighbours.

In terms of costs, these can vary from anything as low as £180 to tens of thousands.

Usually yes, but it depends on your property, or moreover your neighbours property, and the design of your foundations.

If you are excavating foundations within 3 metres of your neighbours property and to a depth lower than their foundations, then you must serve them a party wall notice at least 1 month before works are due to commence.

If you are excavating deep foundations within 6 metres of your neighbours property and your foundations are deep enough to break a 45 degree line drawn down from your neighbours foundations you will need to serve a party wall notice at least 1 month before works are due to commence.
